Can you tell me more about what 'personal misconduct' means?
The sort of conduct we may be able to deal with:
• Discrimination
• Inappropriate behaviour and comments
• Misuse of judicial status (e.g. using judicial title for personal gain)
• Not fulfilling judicial duties (e.g. failing to meet sitting requirements)
• Criminal convictions
• Professional misconduct (e.g. findings by a professional body, such as the Bar Standards Board)
Examples of what OJC cannot deal with:
• Complaints about judicial decision (e.g. length and type of sentence)
• Complaints about case management decisions (e.g. who is allowed to stay in the courtroom, whether a case should be adjourned)
• Complaints where there is not enough detail (not adequately particularised)
• Complaints about judges who no longer holds judicial office (e.g. retired or resigned)
• Where the issue complained about was done by someone else (e.g. HMCS or Tribunal Staff)
